La thèse est une sociologie de la preuve et des enquêtes, appliquée à un corpus de dossiers d'enquêtes policières. Elle est centrée sur une seule question : comment les policiers, sur des affaires d'assassinats, acquièrent la conviction d'une vérité ? C'est une sociologie qui s'intéresse aux critères internes de la vérité, sans relativisme ni recours aux conditionnements externes. Pourquoi et comment les policiers criminels ne peuvent pas dire n'importe quoi, du seul point de vue de leurs investigations ; comment et pourquoi, du seul point de vue de leurs données, ils estiment pourvoir conclure. La démarche a décomposé les manifestations du caractère convaincant de chaque étape d'enquête. L'expérience de la vérité se dramatise et se décompose en différents types et moments d'épreuves (épreuves de plausibilité, épreuves de sincérité, aveux, épreuves de « tenue de soi », tests en troisième personne et tests en seconde personne, etc.). L'idée policière de « faits » peut être analysée avec les ressources d'une sémantique et d'une herméneutique de l’action, reprise de Temps et Récit, de Ricœur, et extrapolée à un domaine où interfèrent l'action vive et l’action racontée. Les « traces matérielles » elles mêmes ne prennent un statut de traces qu'à l'intérieur d'une sémantique de l'action. La recherche a mis en évidence comment la force démonstrative des comptes-rendus repose sur l'articulation de deux temporalités : temporalité des faits rapportés, temporalité de la progression de l'enquête. Les policiers sont des sortes de phénoménologues qui suspendent un temps les modes de conclusion habituels sur « qui a fait quoi », puis y reviennent après avoir seulement décalé et rendu méthodiquement visibles des procédures ordinaires de la certitude de l'action. La thèse montre en quoi ces « intrigues de la conviction » (intrigues au sens de Temps et récit de Ricœur) se différencient des enquêtes de romans policiers.

  • « The Proof of Crimes. An Analysis of Investigations into Crimes »

The approach chosen here deals with the sociology of proof which aims at clarifying the mechanisms of investigation of facts. Based on a set of cases of investigations into crimes/ the author of the thesis tries to understand how the officers (policemen and examining magistrates) are persuaded of the truth, and how a convincing version of criminal facts is worked out.

Far from taking for granted a preliminary notion of the truth which would enable us to evaluate the veracity of the judgement of policemen/ or denying the very idea of truth, the study focuses, through the analysis of documents, on what constitutes the leaven of this truth. It proves that the persuasion of the truth is the result of a work which has been explicitly conducted by the investigators who, at every level, evaluate their discoveries.

This elaboration does not consist in a simple observation of recipes or set criteria of truth which would apply to different versions of facts. The history of facts is written as its validity is evaluated, in a simultaneous way / and conviction presents itself as a dynamic process which develops during the investigation and which is composed of various kinds of tests.

The text which closes the instruction, recapitulating the stages and discoveries of the investigation, reveals the dynamics of this conviction. The whole set of the elements of information are recalled, and mutually confronted and re-examined. A logical order organises these facts according to the probability attached to them, within an « intrigue of the conviction » which puts to the test the elements of investigation through different tests of truth. This logics also describes the usual and sudden developments related to their conviction of the facts. Indeed, the intrigue of the conviction examines the various stages of the investigation which have, each, worked out a specific knowledge according to different tests of truth.

The preliminary investigation which deals with material clues describes a place that permits its interpretation in terms of human action and allows us to decipher, in the background, a human and past intervention. The material mark is not a phenomenon! of perception, or a phenomenon of its own. The stage of hearings brings a knowledge of facts in terms of intentional action, where the preliminary investigation has defined a space for physical events. This new stage gives the opportunity to witness various types of proofs (tests of plausibility, sincerity, narrative, behaviour). These tests lie on the resources of a semantical action which distinguishes plausible action from unplausible one. Such action allows the convict to develop specific and improvise reasoning. The stage of the biographical investigation introduces the sense of responsibility and guilt which were excluded from the tests of truth : even if tests of truth rest on a typicality of behaviour which is familiar to us, they do not reduce criminal action to this typicality; the responsibility of the crime is part of an implacable choice which is totally irrelevant to the reasons of acting brought up in tests of probability.

The various perspectives the investigators have on the enquiry are the result of an interruption of the usual conclusions on « who did what » : according to a logics of appreciations, the notions of actor vary at the different stages of action. Finally, the singularity of the crime, the irreductability of evil are restaured through an approach which structures the possible conditions of action without transforming them into justifications.
